ARTICLE 1 – DEFINITIONS

In these General Terms and Conditions, the following definitions apply:

  • Withdrawal Period: The period within which the consumer can exercise their right of withdrawal.
  • Consumer: A natural person who does not act in the exercise of a professional or business activity and who enters into a distance contract with the entrepreneur.
  • Day: Calendar day.
  • Indefinite Contract: A distance contract concerning a series of products and/or services for which the supply and/or purchase obligations are spread over time.
  • Durable Medium: Any tool that enables the consumer or entrepreneur to store information addressed to them personally so that it can be consulted and reproduced unchanged at a later time.
  • Right of Withdrawal: The consumer’s option to withdraw from the distance contract within the withdrawal period.
  • Entrepreneur: The natural or legal person offering products and/or services to consumers via distance selling.
  • Distance Contract: A contract concluded within an organized system set up by the entrepreneur for the remote sale of products and/or services, using one or more means of distance communication up to and including the conclusion of the contract.
  • Means of Distance Communication: A method that can be used to conclude a contract without the consumer and entrepreneur being simultaneously present at the same location.
  • General Terms and Conditions: These General Terms and Conditions of the entrepreneur.

ARTICLE 3 – SCOPE

These General Terms and Conditions apply to all offers from the entrepreneur and to all distance contracts and orders between the entrepreneur and the consumer.

Before concluding a distance contract, the text of these General Terms and Conditions will be made available to the consumer. If this is not reasonably possible, the entrepreneur will indicate before concluding the distance contract where the General Terms and Conditions can be reviewed and that they will be sent to the consumer free of charge upon request.

If the distance contract is concluded electronically, the text of these General Terms and Conditions may be provided electronically in a way that allows the consumer to store it on a durable medium. If this is not reasonably possible, the entrepreneur will indicate where the General Terms and Conditions can be accessed electronically and that they will be sent to the consumer upon request, free of charge, in an electronic or other format.

If specific product or service conditions apply in addition to these General Terms and Conditions, paragraphs 2 and 3 apply accordingly, and in case of conflicting conditions, the consumer may always rely on the most favorable provision.

If one or more provisions of these General Terms and Conditions become fully or partially void or invalid at any time, the remaining provisions shall remain in effect. The invalid provision will be replaced by a provision that closely aligns with the original intent.


ARTICLE 4 – THE OFFER

The offer is non-binding. The entrepreneur reserves the right to modify and adjust the offer.

The offer contains a complete and accurate description of the products and/or services offered. Apparent mistakes or errors in the offer do not bind the entrepreneur.

All images and specifications in the offer are indicative and cannot form the basis for any claims.


ARTICLE 5 – THE CONTRACT

The contract is concluded once the consumer accepts the offer and meets the specified conditions.

If the contract is concluded electronically, the entrepreneur will take appropriate technical and organizational measures to secure the electronic transmission of data.

If the entrepreneur has legitimate doubts about the consumer’s ability to pay, based on legal frameworks, they may refuse the order or impose special conditions.
